Terms of Use

The conditions for using our informational website, with clear boundaries and respect for your statutory rights.

01About the operator

NOCTIVALE GROUP LTD (brand: NOCTIVALE) is a private company limited by shares, incorporated in Scotland on 8 November 2026 under the Companies Act 2006. Company number: 908352.

Registered office: 57 Shaw Crescent, Aberdeen AB25 3BT, Scotland, United Kingdom.

Contact: contact@noctivale.com.

These terms concern use of Noctivale’s informational website. They are not a consulting engagement agreement, software licence for a product, or commercial service contract.

02Website purpose

The site introduces our technology, intelligence and advisory direction, areas of expertise and work in development. It is intended to provide general information to people considering our work, including UK visitors.

By using the website, you are asked to observe these conditions of use. No payment, service purchase or account registration takes place on this site. If you do not wish to use it on these conditions, please stop using it. Mandatory rights are not affected.

03Permitted use

You may access and read the public pages and download or print reasonable extracts for your own personal reference or internal business evaluation. Keep relevant copyright and ownership notices with copies, and do not present altered content as our original work or imply our endorsement.

This limited permission does not grant a right to resell the content, republish substantial portions commercially, use our branding as your own, or use another party’s material beyond the rights that party grants. Please ask us if you want to use material outside these limits. Uses permitted by law remain permitted.

04Responsible use

You must not use the website unlawfully, impersonate us, introduce malicious code, attempt unauthorised access to systems or data, interfere with other visitors’ access, or place an unreasonable load on the service. Do not circumvent security controls or use contact details to send abusive, unlawful or unsolicited bulk messages.

We may take proportionate steps to protect the site and its users, including limiting access associated with misuse. Nothing here restricts lawful security reporting or a right that cannot be restricted by these terms.

05Intellectual property

Rights in original Noctivale website material and branding belong to NOCTIVALE GROUP LTD or the relevant rights holder. Third-party fonts, software, framework components and other licensed material remain subject to their respective owners’ rights and licences; we do not claim ownership of them.

Except for the limited website-use permission above, applicable third-party licences or permissions provided by law, no intellectual property rights are transferred to you.

06Information, not advice

Website material is general information, not technical, cybersecurity, legal, financial or other professional advice for a particular situation. You should obtain advice appropriate to your circumstances before relying on it for a decision.

Browsing the website or emailing us does not by itself create a client relationship, a duty to provide advice or an agreement to undertake work. Any engagement needs a separate agreement that sets out the work and its applicable terms. Please do not send confidential third-party material or sensitive information without first agreeing an appropriate way to share it.

07Work in development

Labs concepts and products identified as “In development”, including DataGraph, are not statements that a product is available for purchase or operational use. Descriptions express the current direction, which may change or be discontinued.

No release date, final feature set, compatibility, performance or availability is guaranteed by a development description. The website does not imply existing clients, case-study results or certifications unless they are expressly and accurately stated.

09Accuracy and availability

We aim to keep the website accurate and useful, but information may become out of date or contain errors. We may correct or change content, carry out maintenance, or suspend parts of the site. We do not promise uninterrupted availability, that every item is complete or current, or that the site will work with every device.

Please tell us about a material error or access problem using the contact address. These qualifications do not permit misleading statements or reduce obligations that apply by law.

10Liability and your rights

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing removes consumer statutory rights or remedies.

Subject to those protections and to the extent permitted by applicable law, we are not responsible for loss caused by reliance on general website information as if it were tailored professional advice. For business users, we exclude liability for indirect or consequential loss and loss of profit, revenue, business opportunity or anticipated savings arising from use of this free informational website.

If you are a consumer, we do not exclude responsibility for loss that is a foreseeable result of our breach of a legal duty. Loss is foreseeable if it was an obvious consequence or was contemplated by both parties. We do not seek to exclude a duty of reasonable care where the law requires one. No monetary liability cap or indemnity is imposed by these website terms.

Liability for separately agreed services is governed by the relevant agreement and applicable law, not by these website conditions.

11Law and jurisdiction

These website terms are governed by Scots law, subject to any mandatory protections applicable to you. If you are a consumer, this choice does not remove mandatory rights under the law of the place where you habitually live.

The Scottish courts have non-exclusive jurisdiction over disputes concerning these terms. Consumers may also bring proceedings in courts available to them under applicable law, including their home jurisdiction where the law permits. Nothing requires a consumer to give up those rights.

12Updates and contact

We may update these terms to reflect changes to the website or legal requirements. The latest version and its date will be displayed here. Changes apply to subsequent use of the website, not retrospectively to an existing claim, and do not amend a separate service agreement.

Questions about the website or these terms can be sent to contact@noctivale.com.
